Assuming that the name 'Bath City Football Club' is at least protected in some form, the club could issue 'cease and desist' letters to this crowd if it wanted to.

I organised the retro 1960s shirt with Toffs back in 2009. It was all done unofficially including the graphic for the badge which the ex-other half created from a picture of the kit taken from the history book.
I think about 100 shirts were sold which made a profit of around £600 which I gave to the supporters club. Toffs then continued selling them but there was no cut for the club after this. I was asked about this at the start of last season but don't know if it was taken any further. Although I do quite like the shirt that has just appeared (not as much as the new proper one, of course!) it does seem a bit dodgy.

Perhaps part of the attraction is that, even when you add in delivery, they are around a tenner cheaper than the official replica shirts.

Basically the copyright is held by whoever designed the badge, which I believe was in the early 60s, or even 50s. There is no record of who that was at the club so as we can't prove that we own the rights to it there’s no infringement we can take action on.

Yes, that's what I would have thought. When discussing the badge designs, I asked who had designed the current badge, no-one was quite sure but, of course, the club does, at least, own that.

Ken will know. It was part of the relaunch, and some students at what was Bath Technical College down by the Hobgoblin pub, where asked to design a new badge.
As I say, Ken was involved so will know more details.
As we all know, it wasn't met with universal approval.......and still isn't!!

Comrade whilst the club can’t prove that they own the copyright of the old badge (circa 1958), presumably Yuffie or Mrs Yuffie can since they generated the one for the toffs shirts which is where, perhaps , the sloganite one has been sourced.

The main part is the old city of bath council crest presumably no (c) as lost in mists of time. The club logo is very similar but I'm sure they have slightly changed it to avoid (c) issues. The legal issue is are they trying to pass it off - correct legal terms i think,- ie mislead the buyer to think it's genuine, I'd say yes.

Does it really matter? They are hardly likely to sell many and lets face it a club like ours needs to get its name in as many places as it can.
